Whistleblower Actions are Marathons

The simple fact is that whistleblowers must act more like marathon runners and not like sprinters. Neither qui tam cases under the False Claims Act nor administrative claims under agency whistleblower programs will be resolved overnight. In fact, they are rarely resolved in four or five hundred nights.

If you proceed with a whistleblower action, be prepared for your success to come very slowly, if at all. As noted in our False Claims Act Facts & Figures, the government intervenes in less than 22% of all cases filed and less than 5% of recoveries occur in cases declined by the government. In our experience, qui tam cases usually take three to five years to resolve. They rarely take less than three years and frequently take more than five years. Actions under the IRS, CFTC and SEC whistleblower programs can take almost as long.

Understand that you are in for the long haul. Becoming a whistleblower is a decision you will live with for many years and you must be committed to seeing your efforts to completion. Although the wheels of justice often turn slowly, they do turn!
